Zimmerman jury begins 2nd day of deliberations

SANFORD, Fla. - The jury in George Zimmerman's murder trial began a second day of deliberations Saturday morning, weighing whether the neighborhood watch volunteer committed a crime almost a year and a half ago when he fatally shot Trayvon Martin.

Jurors reconvened in the courtroom at 9 a.m. Saturday. A few smiled as the judge addressed them before they left the courtroom to continue their discussions.

The jury began deliberations Friday afternoon as police and civic leaders in this Orlando suburb went on national television to plead for calm in Sanford and across the country, no matter what the verdict.

"There is no party in this case who wants to see any violence," Seminole County Sheriff Don Eslinger said. "We have an expectation upon this announcement that our community will continue to act peacefully."

During closing arguments, the jury heard dueling portraits of the neighborhood watch captain: a cop wannabe who took the law into his own hands or a well-meaning volunteer who shot Martin because he feared for his life.

Zimmerman's lawyers put a concrete slab and two life-size cardboard cutouts in front of the jury box in one last attempt to convince the panel Zimmerman shot the unarmed black 17-year-old in self-defense while his head was being slammed against the pavement.

Attorney Mark O'Mara used the slab to make the point that it could serve as a weapon. He showed the cutouts of Zimmerman and Martin to demonstrate that the teenager was considerably taller. And he displayed a computer-animated depiction of the fight based on Zimmerman's account.

He said prosecutors hadn't met their burden of proving Zimmerman's guilt beyond a reasonable doubt. Instead, he said, the case was built on "could've beens" and "maybes."

"If it hasn't been proven, it's just not there," O'Mara said. "You can't fill in the gaps. You can't connect the dots. You're not allowed to."

In a rebuttal, prosecutor John Guy accused Zimmerman of telling "so many lies." He said Martin's last emotion was fear as Zimmerman followed him through the gated townhouse community on the rainy night of Feb. 26, 2012.

"Isn't that every child's worst nightmare, to be followed on the way home in the dark by a stranger?" Guy said. "Isn't that every child's worst fear?"

One juror, a young woman, appeared to wipe away a tear as Guy said nothing would ever bring back Martin.

The sequestered jury of six women - all but one of them white - will have to sort through a lot of conflicting testimony from police, neighbors, friends and family members.

Jurors deliberated for three and a half hours when they decided to stop Friday evening. About two hours into their discussions, they asked for a list of the evidence. They will resume deliberations Saturday morning.

Witnesses gave differing accounts of who was on top during the struggle, and Martin's parents and Zimmerman's parents both claimed that the voice heard screaming for help in the background of a 911 call was their son's.

Zimmerman, 29, is charged with second-degree murder, but the jury will also be allowed to consider manslaughter. Under Florida's laws involving gun crimes, manslaughter could end up carrying a penalty as heavy as the one for second-degree murder: life in prison.

The judge's decision to allow the jury to consider manslaughter was a potentially heavy blow to the defense: It could give jurors who aren't convinced the shooting amounted to murder a way to hold Zimmerman responsible for the killing.

To win a manslaughter conviction, prosecutors must show only that Zimmerman killed without lawful justification.

O'Mara dismissed the prosecution's contention that Zimmerman was a "crazy guy" patrolling his townhouse complex and "looking for people to harass" when he saw Martin. O'Mara also disputed prosecutors' claim that Zimmerman snapped when he saw Martin because there had been a rash of break-ins in the neighborhood, mostly by young black men.

The defense attorney said Zimmerman at no point showed ill will, hatred or spite during his confrontation with Martin - which is what prosecutors must prove for second-degree murder.

"That presumption isn't based on any fact whatsoever," O'Mara said.

In contrast, prosecutors argued Zimmerman showed ill will when he whispered profanities to a police dispatcher over his cellphone while following Martin through the neighborhood. They said Zimmerman "profiled" the teenager as a criminal.

Guy said Zimmerman violated the cornerstone of neighborhood watch volunteer programs, which is to observe and report, not follow a suspect.

Zimmerman's account of how he grabbed his gun from his holster at his waist as Martin straddled him is physically impossible, Guy said.

"The defendant didn't shoot Trayvon Martin because he had to; he shot him because he wanted to," Guy said. "That's the bottom line."

But to invoke self-defense, Zimmerman only had to believe he was facing great bodily harm, his attorney said. He asked jurors not to let their sympathies for Martin's parents interfere with their decision.

"It is a tragedy, truly," O'Mara said. "But you can't allow sympathy."

With the verdict drawing near, police and city leaders in Sanford and other parts of Florida said they have taken precautions for the possibility of mass protests or even civil unrest if Zimmerman, whose father is white and whose mother is Hispanic, is acquitted.

There were big protests in Sanford and other cities across the country last year when authorities waited 44 days before arresting Zimmerman.

About a dozen protesters, most of them from outside central Florida, gathered outside the courthouse as the jury deliberated. Martin supporters outnumbered those for Zimmerman.

Culprit in bucking SUV may be sensor

Q: I wonder if you can help me figure out why my Chevrolet Suburban has begun to buck sharply at times while driving. It seems to happen at a specific point when I'm going up certain hills. It happens only for an instant, then it's fine again. Ideas? I'm pretty good at working on things, but this has me baffled.

A: This is a tough one, without being there and running some tests. You didn't mention the “service engine soon” light illuminating, so I'll assume the fault occurs too briefly for the onboard diagnostic system to catch it, or it's a pre-1996 model with less smarts.

Your clear description of the symptom makes me wonder if your throttle position sensor could have a glitch. This gadget is attached to the passenger side of your engine's throttle body and sends the engine computer a varying voltage signal that's proportional to throttle opening. With time and mileage, these sensors can become scratchy.

As you open the throttle, the signal voltage is supposed to rise smoothly between about 0.5 and 4.5 volts. Should a brief voltage drop-out occur as the sensor reaches a certain point of travel, the engine computer thinks you jumped off the throttle and cuts fuel injection commands, causing an abrupt power loss, almost as if someone cycled the ignition switch. This sensor is also important for transmission control in 1993 GM SUVs and up, so odd things can happen with shifting and torque converter clutch operation (1981 and up) as well.

Here's a trick that can help when a sensor is suspected of being faulty — unplug it. Modern vehicles are very smart and can cook up a substitute reading for many sensors if the part fails completely or is deemed incompetent.

Unplugging the throttle position sensor is easy, but please do so with the engine off and cold. Upon startup, you'll be greeted by an illuminated “service engine soon” light, but don't worry — you engineered this. Try driving the Suburban in a variety of modes and see if the bucking subsides. Don't expect the engine to run perfectly. Transmission shifting may be a little odd, as you're substituting one problem for another, looking for a difference.

If the bucking stops occurring, renewal of the sensor should fix the problem, although I'd check carefully for an erratic voltage signal first to be sure. If your sensor has elongated mounting screw holes, the replacement part will require a simple adjustment. If the bucking continues, or you're not sure of these procedures, it's time to make an appointment with a sharp technician to get to the bottom of this. Be sure to tell him/her that the diagnostic trouble code in memory, if it's the only one present, was a result of your tinkering.

Beaver Falls lineman Brock Boxen verbally committed to Akron, becoming the second WPIAL football recruit from the 2014 class to pick the Zips.

The 6-foot-3, 260-pound senior will play defensive line for second-year coach Tommy Bowden.

“They made me feel at home,” said Boxen, who also considered Connecticut “I visited some other schools I liked, but at Akron, I could just tell. ... With the new coaching staff there, I wanted to be a part of it.”

Blackhawk quarterback Chandler Kincade, a former Pitt commit, chose Akron in June. Kincade's move influenced Boxen's decision.  

“I was already interested in Akron, but once I heard Chandler committed, I definitely wanted to go check out the school,” Boxen said. “You want to look where other people find a good fit.”

U.S. delays oversight of derivatives overseas

WASHINGTON — A policy allowing a U.S. agency to regulate derivatives trading overseas to help reduce risks to the global financial system will be delayed under a vote Friday.

The Commodity Futures Trading Commission voted 3-1 to stagger the effective dates for the policy. The delay marks a middle ground between Chairman Gary Gensler, who wanted to extend the CFTC's regulation to overseas markets now, and Wall Street banks, which opposed extending its reach.

The Obama administration favored a delay to allow foreign regulators to finalize their own rules for derivatives oversight.

A derivative is an investment that's based on the value of an underlying asset, such as oil or corn or dollars. Bad bets on risky derivatives, and lax regulation of them, were a leading cause of the 2008 financial crisis.

The CFTC policy applies new rules governing the $700 trillion derivatives market to U.S. banks' foreign affiliates that trade derivatives and to U.S. trading operations of foreign banks.

The agency's new oversight rules were mandated by the 2010 financial overhaul law. One requires banks that trade derivatives to put up money to cover potential losses. Another would require most derivatives to be traded in clearinghouses to make prices more transparent.

Under Friday's vote, the new rules would be phased in overseas starting in September.

The CFTC commissioners also agreed to have European regulators monitor derivatives trading in their countries if their oversight rules closely resemble the CFTC's. By March, European banks with trading operations in the United States will have to meet the requirements.

On Thursday, the CFTC and the European Commission announced an agreement to coordinate their derivatives rules.

“What happens in one nation impacts another,” Commissioner Bart Chilton said before the vote. “Risk travels around the globe with a click of the mouse.”

Proponents of the wider reach for the CFTC say regulations overseas tend to be weaker and that stricter supervision is needed to reduce the risk to the broader financial system.

Banks and other opponents counter that the CFTC's rules will make it harder for U.S. firms to remain competitive in some foreign markets.

Bernie Galiffa came from a family of quarterbacks

Not too many Valley athletes can stake the following claims: 1) having played for a head coach who ranks as the winningest ever at a major college (Bobby Bowden); 2) having an uncle who was an All-American quarterback and two brothers who also quarterbacked at the college level; 3) holding major quarterback records in high school and college.

The only man who has such a resume is Donora's Bernie Galiffa.

From his days of youth baseball where he pitched to Speer Ruey (when he wasn't catching), to his days quarterbacking the Donora Dragons from 1965 through his senior football season (1967), all the way to his stint playing quarterback at West Virginia University under Bowden, Galiffa's career was a glorious one. Furthermore, with All-American Arnold “Pope” Galiffa of Army for an uncle, his bloodlines are strong.

Bernie Galiffa said he was always aware of his heritage.

“That was always there,” he said. “They wrote and compared me to him, but there was no comparison—he was just something special.”

Galiffa, who also starred in high school basketball and baseball, said he didn't try to emulate his uncle.

“Every time I did something, good or bad, his name was always brought up. I was always ‘the nephew of Pope Galiffa.' That's just the way it was.”

Galiffa was close to his uncle, but Pope never really became an unofficial coach for Bernie. Once, though, Pope posed with his three nephews in his backyard. The treasured photo features Pope showing the boys how to hold a football properly.

“Other than that, he pretty much stayed out of it,” said Bernie. “He just wanted to let my coaches coach me.”

But Pope faithfully attended football games at Legion Field to see his nephews play. They would all go on to become college quarterbacks, with Ron at Geneva College (in Beaver Falls) and Art at Tennessee.

Bernie related an incident from his sophomore season when Ron was a senior.

“They put me at quarterback and moved him to running back. They said, ‘You can't quarterback anymore.' I don't think he liked that too well.”

As a kid Bernie never pretended to be a famous quarterback, but he was aware he was growing up in Western Pennsylvania, a factory for quarterbacks from George Blanda to Joe Namath.

Speaking of Namath, Galiffa recalled “in high school I broke his records,” earning him mention in the prestigious “Faces in the Crowd” column in Sports Illustrated. The article stated Galiffa clicked on 88 of 149 passes as a senior, good for 22 touchdowns and 1,873 yards, “to surpass Joe Namath's Western Pennsylvania mark (77 of 125 for 17 and 1,115).” Galiffa didn't just break Namath's records. He annihilated them.

Galiffa said his best college game was when he faced Penn State in a televised contest.

“That was back when they were giving away the Chevrolet Player of the Game award—they gave $1,000 to the school in your name and I won that even though we lost the game. It was one of those kinds of games where I just couldn't miss.

“But at the beginning of the game, the first two passes I threw were interceptions. One I threw slipped out of my hand and went straight up in the air. The next pass I threw, my receiver slips and falls and a defender got the ball.”

As a senior, his Mountaineers went 8-4 and were ranked as high as No. 18 nationally before they lost in the Peach Bowl. That year Galiffa's quarterback rating stood at 118.5. By comparison, Joe Montana's rating as a Notre Dame senior was 124.9.

Galiffa also became the first quarterback in West Virginia history to throw for over 2,000 yards.

“I was in their record book for total passing yards in a season (2,496),” he said. “And the guy that broke it was Mark Bulger [in 1998]. So from the time when I left there in '72 I held that record.”

Stars such as Oliver Luck, Jeff Hostetler and Major Harris couldn't eclipse the mark.

“Now they're just blowing that record out of the water. Those guys throw the ball every down,” Galiffa said.

The same holds true for career passing yardage. For a time, Galiffa held that WVU record with 4,426, but by the late 1990s men such as Bulger were heaving the football for 3,000-plus yards.

Galiffa said WVU “ran the triple option so I was supposed to run, but I did. I made sure that the [defender] took me; I pitched the ball because I had good running backs. I had Kerry Marbury, I mean he was outstanding.”

Considering Galiffa's bad knee, he was wise to let others lug the football. Galiffa laughed when he pointed out that he posted negative yardage, minus-132 for the 137 times he did run.

It didn't matter.

“I had great receivers like Danny Buggs, Marshall Mills and Bernie Kirchner. They made me look pretty good.”

So good, he wound up throwing 17 touchdowns as a senior and 28 overall, connecting on nearly 50 percent of his passes.

Those numbers impressed the New York Giants.

“I had a contract in my hand from them” he said. “I even had a phone call from Bert Wolf. Back then he was a big agent. He only took first-round, second-round guys. He called me up. He said, ‘When you get up here to New York, I want you to give me a call.' I'm thinking, ‘Hmmm! OK, I'll call you.' Galiffa is now retired, living in Wilmington, N.C., with his wife Rose and his 16-year-old daughter Julia. Now, instead of dodging blitzing linebackers, he takes it easy, enjoying life on the beach.

West Mifflin earns top seed in Allegheny South Legion playoffs

A small late-season winless streak wasn't enough to knock West Mifflin out of the top spot in the Allegheny South League American Legion playoffs.

West Mifflin (10-1-1), the defending champ that ended the regular season 0-1-1 after four starters went on vacation, won the “B” Division and received a first-round bye in the tournament. Play is set to begin Saturday at, if last year is any indication, both Peterswood Park in Peters Township and Boyce Mayview Park in Upper St. Clair.

Coaches and league officials met Friday evening to determine scheduling, but sites and times were not released.

“Having the bye gives us a little more freedom with our pitching staff, especially since we're going to be missing a couple guys Saturday who we might have on Sunday,” West Mifflin coach Tom Simcho said. “That's a nice thing.”

In a tournament like this, where the team could be playing every day, having an extra off-day to line up pitching is extremely beneficial. So, too, is staying in the winner's bracket where it's easier to keep a rotation intact.

American Legion tournament rules dictate that each pitcher cannot throw more than 12 innings or make more than four appearances in any three-day period.

About the only downside to the bye is the team won't be able to get an extra practice or game in before it plays its first contest Sunday at a site and time to be determined. Most of the players on the West Mifflin Legion team also play for Quinn Construction in the Daily News League, but the Mudcats don't have a game scheduled in the next couple of days.

“We were trying to get a couple Mudcats games for (Saturday) but we don't have anything scheduled,” Simcho said. “A lot of the guys like Zack Salmon, (Ryan) Kandsberger and (Zack) Miller, they've been playing Daily News League, so they should be fine, but the rest of them, who knows?”

First baseman Joe Stavor, left fielder Dan Howard, leadoff hitter and second baseman Zach Lapko and right fielder Jim Carassanesi should return for the playoffs and bring back some of the offensive thrust that had the team averaging 8.5 runs per game during its season-opening 10-game winning streak.

The extra day also means that third baseman Zach Fodor and pitcher Cody Gross likely won't have to miss any games as they were expected to miss only Saturday because of vacations.

About the only challenge now that the full lineup is intact is what to do with outfielder Chuck Scales, who performed well in the leadoff spot and in left field while Howard and Lapko were away. In limited action Scales, who is a rising senior at Shady Side Academy, hit .692 (9 for 13) with two doubles, a triple, six RBI and four stolen bases.

“He's been a pleasant surprise,” Simcho said. “He's been doing better at the plate than I thought, and he's run down a lot of balls in the outfield. He's that hot and he's been hitting the ball that well, I want to get him up near the top of the order, so I might put him in the two spot because Zach Lapko is a prototypical guy in that one spot.”

Still, if coming up with a lineup is the most difficult thing West Mifflin has to do in the tournament, then a spot in the Region 6 finals July 20-24 at Blackhawk is a virtual lock.

“I'm pretty good at putting together a lineup,” Simcho said. “I usually just do it five minutes before a game, so we'll be fine.”

Ambush kills 7 U.N. peacekeepers in Sudan's Darfur region

CAIRO — Gunmen ambushed a United Nations peacekeeping team Saturday in Sudan's western region of Darfur, killing seven and wounding another 17 in the deadliest ever single attack on the international force in the country.

The assault included sustained heavy fire from machine guns and possibly rocket-propelled grenades, targeting the force some 25 kilometers (15 miles) west of the town of Khor Abeche, U.N. forces spokesman Chris Cycmanick said. Reinforcements later arrived to rescue the wounded, who included two female police advisers, the force said in a statement.

It wasn't immediately clear if any civilian personnel accompanied the team into the ambush, Cycmanick said. He declined to give the nationalities of those killed and wounded in the attack. About 40 countries have contributed military personnel or police to the peacekeeping force.

No group immediately claimed responsibility for the assault. A February report by a U.N. panel of experts said that some armed opposition groups angry about the presence of peacekeepers have called the force "a legitimate target."

Peacekeepers have been targeted by assailants in the past in the region since the international force began its work there in 2008. In the last fatal attack, gunmen shot dead a Nigerian peacekeeper in April in East Darfur State. Before Saturday's attack, 150 people associated with the U.N. mission in Darfur had been killed while on duty in the region, according to the force's website.

The joint African Union-U.N. peacekeeping force, dubbed UNAMID, was established to protect civilians in Darfur, but also contributes to security for those providing humanitarian aid, verifying agreements, political reconciliation efforts and promoting human rights. It has about 16,500 troops and military observers and over 5,000 international police.

Darfur has been gripped by bloodshed since 2003 when rebels took up arms against the government in Khartoum. Fighting also erupts between tribes in the region. More than 300,000 people have been killed in the conflict.

Unrest continues to grip the region. About 300,000 people have fled fighting throughout Darfur in the first five months of this year, the U.N. has said.

"The mission condemns in the strongest possible terms those responsible for this heinous attack on our peacekeepers," said Mohamed Ibn Chambas, a joint special representative of the force. "The perpetrators should be on notice that they will be pursued for this crime and gross violation of international humanitarian law."

More than 100 U.N. peacekeepers were killed last year alone on duty in the Darfur and Abyei regions of Sudan, Congo, Ivory Coast and other countries. Eight more civilian contractors, such as pilots, also died on deployment with peacekeeping missions in 2012.

Mt. Pleasant teen faces prison in self-defense shooting of Fayette man

Although a Westmoreland County jury on Friday sided with a Mt. Pleasant teenager's claim that he shot a Fayette County man in self-defense, the teen still faces a mandatory prison term of five years.

Jurors found Keenan D. Frye, 19, not guilty of attempted homicide, reckless endangerment and aggravated assault in the shooting of Josh Grimm, 28, of Everson on Oct. 17 along South Silver Street in Mt. Pleasant.

But jurors convicted Frye of illegal possession of a firearm, a count that carries a mandatory five-year sentence. In addition, the jury convicted Frye of three drug-related charges.

Grimm had set up a late-evening meeting with Frye, via text messages, to allegedly purchase marijuana, according to testimony in the three-day trial.

Witnesses testified that after Frye arrived, Grimm jumped Frye, knocked him to the ground and sprayed him with Mace as Grimm tried to rob Frye of marijuana and money.

Frye pulled a handgun out of a book bag he was carrying and fired four shots, striking Grimm's shoulder and left side.

“This is a classic case of self-defense,” defense attorney Emily Smarto told jurors in a closing argument. “The victim provoked the use of force. …”

Smarto said that trial testimony from Grimm and two of his friends indicated a planned attack against Frye, with Grimm's “posse hiding in the bushes, watching nearby.”

Jurors dismissed Smarto's contention that Grimm hid the gun in the vicinity of the planned ambush.

Assistant District Attorney Jacquelyn Knupp conceded the shooting was a difficult case to prosecute because “they both came with dirty hands” and numerous witnesses testified Grimm threw the first punch.

“This case is the Commonwealth versus Keenan Frye, not Josh Grimm versus Keenan Frye,” Knupp said.

She dismissed Smarto's argument that Grimm stashed the book bag with the gun at the scene before the confrontation.

“Trooper Brian Pollock testified that when he picked Keenan Frye up later, the gun was ready to go again … it was fully loaded … it shows that he's mentally prepared to shoot again,” Knupp said.

Police found the gun in a book bag that contained more than an ounce of marijuana, separately packaged.

Knupp said Frye was carrying the gun “to protect the drugs he was selling and his reputation on the street.”

After the verdict, Frye's mother, Cindy Myers of Mt. Pleasant, said the family remains devastated.

Lester Frye said his son was attempting to protect himself.

“It's ironic the victims who testified played out their roles of victims,” although Keenan Frye was the victim of an attempted robbery, Lester Frye said.

Trial Judge Rita Hathaway said that a sentencing hearing will be scheduled within 90 days.
